Terms and Conditions

Last updated: September 18, 2026 · COUNTY CRAFTSMEN CONSTRUCTION CORP

1. Agreement Acceptance

COUNTY CRAFTSMEN CONSTRUCTION CORP ("Company," "we," "our," or "us") provides these Terms and Conditions to govern your access to our website and our professional residential construction, remodeling, and general contracting services. By requesting a project estimate, communicating with us, or authorizing site work, you ("Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, except where a separate written construction agreement governs a specific project.

2. Services Description

We provide professional general contracting services specifically focused on single-family housing construction and general remodeling. This includes, but is not limited to: full home renovations, kitchen and bath remodels, room additions, structural repairs, and exterior property improvements. The specific project scope, architectural blueprints, materials specifications, pricing, and Massachusetts statutory warranties will be defined exclusively in a separate, fully executed written construction contract or change order.

3. Project Estimates and Approvals

Unless otherwise stated in writing, initial residential construction estimates provided by our team are valid for 30 days from the date issued. Estimates are based on visual inspections and information reasonably available at the time. Final costs may change due to concealed or unforeseen structural conditions discovered during demolition (e.g., hidden water damage, outdated knob-and-tube wiring, out-of-code framing), permit requirements, changes in lumber pricing, or client-requested upgrades. Any material deviations require a formal, written change order approved by the Client before additional work proceeds.

4. Financial Responsibility and Billing

Clients are strictly responsible for funding their construction projects according to the payment schedule and milestone terms contained in their specific construction agreement. Deposits are generally required before our crews begin ordering custom materials (e.g., cabinetry, windows) or scheduling specialized trade subcontractors. In accordance with state law, we reserve the right to suspend work for materially delinquent payments and may apply a statutory mechanic's lien under Massachusetts law to the property for unpaid contracting fees, labor, or building materials.

5. Site Access and Property Preparation

The Client agrees to provide the Company's carpentry crews, tradesmen, subcontractors, and municipal inspectors with reasonable, safe, and unobstructed access to the property during scheduled working hours. The Client is strictly responsible for securing personal belongings, keeping pets indoors, and ensuring that children remain clear of the active construction zone prior to our daily arrival.

6. Scheduling and Excusable Delays

Project schedules and construction milestones are approximate unless expressly guaranteed in a separate written agreement. The Company shall not be responsible for delays caused by circumstances beyond its reasonable control, including severe New England weather conditions (e.g., heavy snow or freezing rain affecting exterior work), material supply chain shortages, delays by local municipal building inspectors, or unmarked utility conflicts.

7. Jobsite Safety and Operations

During active remodeling, Clients and their representatives must maintain a safe distance from our heavy machinery, power tools, open trenches, and active structural framing zones at all times. Unescorted visits to the active jobsite are strictly prohibited to comply with OSHA safety regulations and liability reasons. All construction equipment provided by the Company is to be operated exclusively by our trained staff.

8. Customer Responsibilities and Underground Utilities

You agree to accurately identify property lines and provide complete information reasonably necessary for the Company to perform the services. Crucially, the Client is responsible for disclosing the location of all private underground utilities (e.g., invisible dog fences, private septic lines, landscape lighting) prior to any exterior excavation or addition work. We will contact Massachusetts Dig Safe (811) for public utility locates as required by law prior to major earthwork.

9. Limitation of Liability

The Company maintains comprehensive commercial professional and general liability insurance. However, to the fullest extent permitted by applicable law, the Company's aggregate liability arising from its services will be strictly limited to the direct cost of correcting our specific scope of work as permitted under the applicable agreement. We are explicitly not responsible for pre-existing foundation issues, indirect, incidental, special, exemplary, or consequential damages.

10. Mobile Communication Terms (Customer Service Only)

If you voluntarily opt-in to receive text messages from us, you agree to receive automated SMS/MMS messages strictly for operational project management, construction schedule updates, and customer service communications. We do not use text messaging for marketing or promotional campaigns.

Operational message examples include: "COUNTY CRAFTSMEN: The municipal building inspector has approved the rough framing for your remodeling project today."

Message frequency varies based on the active phase of your construction project. Message and data rates may apply. Consent is completely voluntary and is explicitly non-mandatory; opting out will not affect your ability to secure our residential construction services. You may withdraw your consent at any time by replying STOP. For help, reply HELP.

We strictly protect your mobile data. We do not share, sell, rent, or trade your mobile phone number or SMS opt-in consent data with any third parties, affiliates, material suppliers, or external subcontractors for any purpose.

11. Intellectual Property

Unless otherwise agreed in writing, architectural floor plans, 3D renderings, proposals, designs, and project photography created by COUNTY CRAFTSMEN CONSTRUCTION CORP remain the exclusive intellectual property of the Company. Clients may not reproduce, distribute, or use proprietary materials for another project or third-party contractor without the Company's express written permission.

12. Dispute Resolution and Governing Law

These Terms and Conditions and all residential construction contracts shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any legal disputes arising from our services must be resolved through good faith negotiation. If litigation becomes necessary, both parties consent to the exclusive jurisdiction of the state and federal courts located in Norfolk County, Massachusetts.

13. Indemnification and Severability

You agree to fully indemnify and hold harmless the Company, its crews, and staff from any claims, losses, damages, or liabilities arising from your material misrepresentation of property boundaries, structural history, or failure to disclose known private underground utilities prior to excavation. If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, that specific provision shall be limited to the minimum extent necessary so that the remainder of these Terms shall remain in full legal effect.
